TERMS & CONDITIONS
1. This Sunfeast Fantastik Cashback Carnival Contest (“Contest”) is launched by ITC Limited. The Contest is organized by Mobilnxt India Pvt. Ltd. . This Contest is open only to wholesalers and retailers, who are of age 18 years and above as on 20/05/2025.
2. Retailers/Wholesalers participating or seeking to participate in the Contest shall individually be referred to as "Participant" and collectively as "Participants". If you participate in the Contest on behalf of a business entity, you represent that you have the requisite capacity and authority to accept these terms and conditions (hereinafter referred to as the “Terms & Conditions”) on behalf of the business entity.
3. Participation in this Contest is purely voluntary. Participation in this Contest implies unconditional acceptance of these Terms.
4. By participating in this Contest, each Participant is deemed to have read, understood and accepted the complete terms and conditions of this Contest available on www.sunfeastfantastik.com/tpromo (“Contest Website") as well as the decisions of ITC which are final and binding in all matters related to the Contest. Successfully entering the Contest and winning a prize/prize(s) is subject to all requirements set forth herein.
ELIGIBILITY:
1. This Contest is open to residents of India only.
2. Participants below 18 years of age are not allowed to participate in this Contest.
3. This Contest begins on 20.05.2025 (“Contest Period”). No entry will be entertained after 15th Aug 2025.
4. This Contest is applicable only on wholesale packages containing Sunfeast Fantastik Fruit n Nut Rs. 10 at 13.5 g and Sunfeast Fantastik Choco Almond Rs. 10 at 12.5 g.
5. This Contest is subject to all applicable central, state and local laws and regulations.
6. The following persons are not eligible to participate in the Contest: employees, agents, associates, and promoters of ITC’s and of its affiliates, subsidiaries, and advertisement agencies including their immediate family members (spouse, parent, child, sibling, grandparent and/or “step”) and all others directly associated with organizing the Contest.
7. ITC reserves the right to cancel/amend/extend the Contest Period without giving any notice/intimation. No claims /questions shall be entertained in this regard.
STEPS TO PARTICIPATE:
1. To participate in this Contest, Participants should follow these steps –
a. Purchase any wholesale package of Sunfeast Fantastik Fruit n Nut Rs. 10 at 13.5 g and Sunfeast Fantastik Choco Almond Rs. 10 at 12.5 g. (hereinafter referred to as the “OUTER”) during the Contest Period. Each OUTER will contain a pamphlet with a Unique Code (hereinafter referred to as “Code”)
b. Scan the QR Code on the pamphlet. The QR Code will redirect you to the Contest Website https://fantastikcarnival.com The Participants will have to enter their name, mobile number, e-mail id, State and UPI ID as prompted.
c. Accept the terms and conditions on the Contest Website.
d. The Participants should enter the Code provided on the pamphlet inside the OUTER.
e. Once the Code is validated, the Participants will receive the assured cashback of Rs. 10 in their bank account through the UPI ID used to enter into the Contest (hereinafter referred to as “Cashback”).
f. The Participant can purchase multiple OUTERs and follow the same steps provided above to avail higher Cashback amounts. The details of Cashback are as follows:
i. Purchase of 2nd OUTER – Assured Cashback of Rs. 15 on the 2nd OUTER
ii. Purchase of 3rd OUTER – Assured Cashback of Rs. 20 on the 3rd OUTER
iii. Purchase of 4th OUTER – Assured Cashback of Rs. 25 on the 4th OUTER
iv. Purchase of 5th or more OUTER – Assured Cashback of Rs. 50 on each OUTER subsequent to the 5th OUTER.
g. The Participants will have to enter the same name and mobile number for each repeat purchase of the OUTER to avail the Cashback detailed above.
h. For one Mobile Number the maximum limit which can be claimed through this contest is Rs.2,500/-
2. Participants will have to share their correct UPI ID and the transfer will be done only to the UPI ID provided by the Participants.
3. If a Participant has purchased an OUTER with the Code before the commencement of the Contest Period, then the Participant will be ineligible for participation in the Contest until the start of Contest Period i.e., 20/05/2025. A Participant who has purchased an OUTER during the Contest Period, can redeem the cashback till ¬¬¬15th July 2025. Participants who have purchased a OUTER with the Code after the end of the Contest Period will be ineligible to participate in the Contest and their participation will be rejected.
4. The disbursement of the Cashback will be only through the method stated herein, and disbursement through any other form is not permissible.
5. Participants may submit multiple entries in this Contest basis the number of wholesale packages purchased.
6. The pamphlet containing the Code cannot be exchanged for cash/vouchers/credit notes. The pamphlet will not be replaced if lost.
7. ITC reserves the right to change the Terms & Conditions of this Contest, including extending, withdrawing, or discontinuing the same without notice, without assigning any reason, at its sole discretion, without any liability. ITC shall not be liable in any manner for any claim arising out of, or in respect of this Contest.
8. ITC shall not be responsible for (i) any incorrect or incomplete details provided by the participant and/or delay in receipt of communication and/or non-receipt of communication for any reason whatsoever, (ii) any charges, levies, costs if incurred by the participants to participate in this Contest, (iii) any loss of data due to server issues and other technical faults that may occur during real time monitoring of the submission of entries, (iv) errors, omissions, interruptions, deletions, defects, delays in operation or transmission, theft, destruction, unauthorized access or alteration by a participant or third party. ITC, in its sole discretion, reserves the right to disqualify any person tampering with the operation of the Contest, or engaging in fraudulent or unethical behaviour, or violating or otherwise not meeting these Terms.
9. Sunfeast Fantastik is an exclusive trademark / brand of ITC.
10. ITC reserves the right to exclude any person from participating in the Contest on grounds of misconduct or criminal record.
11. ITC reserves the right to terminate, modify or extend the Contest, at any time at its absolute discretion, without assigning any reasons.
12. If this Contest is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of ITC, including but not limited to technical difficulties, unauthorized intervention or fraud, ITC reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to invalidate any Participant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Contest, as appropriate.
13. If for any reason this Contest is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorized intervention, technical failures or any other causes beyond the reasonable control of ITC, which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, ITC reserves the right in its sole discretion to cancel, terminate, modify or suspend the Contest.
14. By sharing their personal information with Mobilnxt India Pvt. Ltd.the Participants consent to collection, storage, processing and usage of personal information i.e., Name, Mobile number, e-mail, State, Pin code, UPI ID details by Mobilnxt India Pvt. Ltd.,, its affiliates, associates, agents and contractors and other third parties.
15. Personal information given by the Participants shall be used for promotional activities by ITC, its affiliates, associates, agents, contractors. The personal information is being collected by Mobilnxt India Pvt. Ltd.,and shall be retained by Mobilnxt India Pvt. Ltd.,
16. The Participants have an option of not providing the personal information as required under this Contest. The Participants also have an option to withdraw their consent in relation to usage of personal information during the Contest Period. In such cases, the entry of the Participant shall not be considered and Participant shall not be eligible for the Prizes. The Participant may reach out to tarun@mobilnxt.com for such withdrawals.
17. By participating in this Contest, the Participants acknowledge and consent to transfer and/or disclosure of their personal information by ITC to any third-party for providing services in relation to this Contest.
18. By availing the Cashback and/or taking part in the Contest, all Participants agree that ITC shall be at liberty to use Participant’s name and/or photo and/or video that may appear in any advertisements / promotions/media coverage or publicity in any form which exists today or will be known anytime in the future, without any consideration to the Participant. No fees or other sums are to be paid to the Participants on account of taking part in the aforementioned advertisements / promotions.
19. ITC accepts no liability, whether jointly or severally, for any errors or omissions, whether on behalf of itself or third parties in relation to the Cashback.
20. ITC shall not be liable for any delays or failures in its performance hereunder resulting from any pandemic, epidemic, weather conditions, fire, flood, hurricane, strike, war, riots, political unrest, civil commotion, terrorist attacks or any other event amounting to Force Majeure or causes beyond its control. In such circumstances, ITC has the right to cancel or suspend this Contest or carry out any other action as may be determined by it in its sole discretion.
21. ITC, its officers, directors, employees, agents, successors, or assigns are not liable and do not have obligation with respect to (i) notifications, communications, or materials sent by a Participant that are lost, late, misdirected, garbled, inaccurate, incomplete, illegible, unintelligible, damaged or otherwise not received by ITC, in whole or in part, due to computer, post office or technical error of any kind, (ii) telephone, electronic, hardware, software, network, Internet or computer malfunctions, failures or difficulties, (iii) power-related or weather-related events of any kind, and/or to any event not under ITC direct control, (iv) entries or other communications from customers that contain inaccurate information or do not comply with these rules, (v) errors, omissions, interruptions, deletions, defects, delays in operation or transmissions, theft, destruction, unauthorized access or alterations by Participants or third parties, (vi) if the Participant has registered himself to the DND of the telecom provider/ the Participant has registered with National Do Not Call Registry/ Participant has specifically requested for not receiving messages for the specific Contest (vii) any damages or losses of any kind resulting from acceptance, possession, or use of any Prize. ITC, in their sole discretion, reserves the right to disqualify any person tampering with the entry process or the operation of the Contest or otherwise violating these rules. ITC further reserves the right to cancel, terminate or modify this Contest if this Contest cannot be completed as planned because of infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort.
22. No liability or responsibility is assumed by ITC resulting from the Participant's participation in or attempt to participate in the Contest or ability or inability to upload or download any information in connection with the Contest. No responsibility or liability is assumed by ITC for technical problems or technical malfunction arising in connection with any of the following occurrences which may affect the operation of the Contest: Hardware or software errors; faulty computer, telephone, cable, satellite, network, electronic, or Internet connectivity or other online or network communication problems; errors or limitations of any Internet providers, servers, hosts or other providers; garbled, jumbled or faulty data transmissions; failure of any online transmissions to be sent or received; lost, late, delayed or intercepted transmissions; inaccessibility of the Web Site in whole or in part for any reason; traffic congestion on the Internet or Web Site; unauthorized human or non-human intervention of the operation of the Contest, including without limitation, unauthorized tampering, hacking, theft, virus, bugs, or worms; or destruction of any aspect of the Contest, or loss, miscount, misdirection, inaccessibility or unavailability of an email account used in connection with the Contest. ITC is not responsible for any typographical errors in the announcement of prizes or these Terms and Conditions, or any inaccurate or incorrect data contained on the website. ITC is not responsible for any personal injury or property damage or losses of any kind which may be sustained to participant’s or any other person's computer equipment resulting from participation in the Contest.
23. Any incidental charges, including statutory levies, are to be borne by the Participant.
24. By entering the Contest, the Participant hereby releases from and agrees to indemnify ITC and/ or Agent or any of its respective officers/employees from and against all liability, cost, loss or expense arising out of acceptance of the Cashback or participation in the Contest including (but not limited to) personal injury and damage to property and whether direct, indirect, consequential, foreseeable, due to some negligent act or omission, or otherwise.
25. ITC shall under no circumstances be liable, whether jointly or severally, for any loss or damage suffered or sustained (including but not limited to consequential loss), including for personal injury or property damage suffered or sustained or any costs incurred, as a result of acceptance of the Cashback.
26. ITC or the Promotion Parties shall not be liable for any loss due to delay or destruction or damage of or inability to provide the Cashback due to Act of God, Governmental actions, riots, loss/damage/delay due to courier services and other force majeure circumstances and shall not be liable to pay any amount as compensation, or damages, for any such loss, delay or damage.
27. All disputes arising out of, or in connection with, this Contest shall be subject to the exclusive jurisdiction of Courts at Bengaluru.
